You may have recourse for the failure to disclose against the previous owner and the real estate agent if he was also aware of the issue and the sellers failure to disclose. Did you have a home inspector look at the property before you bought. If the damage was evident or reasonably visible the inspector you hired may also be responsible. But there are statute of limitations issues which may vary based on the legal theory. frauf or negligence is two years from the act or possibly when you discovered the problem depending on the situation. There may also be actions based on contract where the statute of limitations may be longer. I would advise you immediately speak with an attorney to see how the facts apply to your situation.
