Legal Question in Real Estate Law in Pennsylvania

Rights of Shared Driveway

I own a home that has a shared driveway. The driveway is shared with one neighbor. This neighbor's teenage friends pull all the way into the driveway at all hours of the day and night. I have young children and am concerned about their safety in the driveway. I asked one teenage, who pulls into the driveway often, if she would stop pulling in, yet she still does it. I spoke with my neighbor and she got very huffy about the situation. Can I keep non-residence from entering the shared drive?

I have included a copy of the clause from my deed:

TOGETHER with the free and common use, right, liberty and privilege of the aforesaid driveways as and for a driveway, passageway and watercourse in common with the owners tenants and occupiers of the other lots of ground bounding thereon and entitled to the use thereof at all times hereafter forever, SUBJECT, however to the proportionate part of the expense of keeping said driveway in good order and repair.

Re: Rights of Shared Driveway

There is very little you can do. Once a neighbor dispute starts the only solution is for one of the neighbors to move. If they are not reasonable or interested in your concerns you have little option. Even if you did you would not have a happy neigbor after you sued them. I suspect they will make you miserable as a result. You both have unrestricted access and use of the driveway. Gerald Hershenson Esq. 215-579-9390
