Re: righttosell

Your question does not indicate whether the daughter in law purchased the house or had it purchased for her prior to marriage. You also do not indicate if there is any legal action pending between your son and daughter in law ie divorce. In a divorce action there are remedies including special relief which could prevent the sale by the daughter in law pending divorce issues. If the parties are not involved in a divorce the wife could theoretically sell the property without husband though many title companies may want him to join in on the deed. If no divorce is involved He could seek equitable action for an injunction preventing the sale of the property. In any event your son should consider contacting an attorney who can review all the facts and advise of the appropriate recourse.
