Tenants in Common and Forced Sale

I own property with one other equal owner, as tenants in common. He has moved and not contributed towards mortgage, taxes or maintenance in 4 years. Now I want to sell and split 50/50, but he does not want to sell. Can I force a sale? How expensive will that be? If I prevail in the action, should he have to share the costs? If he moves back into the property, does that change anything legally?

Your best course of action is an action for partition. You could also ask for costs and attorney fees as well as his unpaid portion of upkeep and taxes. I offer free consultations.
