Legal Question in Social Security Law in Pennsylvania

Past SSD benefits owed

We received a letter in May 2006 from SSA regarding the $15000 due us,and we have yet to see a penny. Is there a law regarding how much time SSA has to pay the back benefits owed? It seems like a long time, and our lawyer was paid 2 months ago!!

Re: Past SSD benefits owed

There are Regulations that say SSA must pay promptly but many factors can slow down the payment. SSA is required to fully evaluate for offsets too. If you have both SSI & SSD pending or if you received workers' compensation, there is accounting work to do that can delay the payment. Several other things, such as tax liens & outstanding child support, can effect & delay payment.

I am sure your lawyer has explained this to you. Perhaps you should call your lawyer -

His/her work is not done until you have received your money.

Ask your lawyer to call the office in Baltimore assigned to your SS# and talk to the MOD manager or Asst manager regarding the delayed payment.

You can also learn about the problem by contacting your local SSA office. Answering such questions is part of their job too. You should also ask them about your monthly payments.
