Accident Witness

I was recently in a car accident in which an older man turned left and at an intersection and hit me. I wasn't speeding, nor was the light yellow or red. I was somehow summonsed and have to appeal in court. I have a witness that was behind the man who hit me and says he turned into me and had no chance of not hitting me even though I tried to swerve. Is my witnesses testimony written down and notarized enough to bring to court with me? Or will the judge not accept that and I will lose the key fact that I have in this case?

You don't say whether you're being charged with a traffic offense by the police or being sued by the other driver. You don't say what kind of court you're in.

However, to answer your general question, no, you can't take a piece of paper to court. A piece of paper can't be cross-examined. You have to take the person.

And, I'd suggest you take a lawyer too.

You need to subpeona the witness to appear. An affidavit is in admissible at a hearing because the opposing party does not have the opportunity to cross examine.
