Legal Question in Wills and Trusts in Pennsylvania

Family issues blocking settlements

Last parent died April 2006. Promised 1/3assets by 12/06.

One brother is accused of stealing ''Will'' items and non-will items stored at other brother's home.

Theft victim is accused of taking funds that were not his. Police reports have been filed.

I am in the middle, I do not even know, if, either side has, actually, done anything wrong. Real criminals could have actually done the theft!!!I know I did not do anything.

But it looks like I will not get my money for many years at this rate, or maybe never. Both brothers are annoyed at me because I am not siding with them, so now I have lost my brothers, too.

There is an executor, but he is a college friend of my ''break-in'' victim brother.

The ''break-in victim'', also appears to be having significant mental and physical health considerations.

Could my brothers end up in jail? Can I do anything to freeze my part so that it is not chewed up in their legal battles? Where should I start?

I believe you may want to file some petition in the Orphan's Court to have the present Executor removed and replaced by someone else. You should immediately seek legal counsel to discuss this matter

It does sound like this has the potential to become a complicated estate because of the family disputes. If you would like to meet with Sam Rossitto, one of my partners, just e-mail me your e-mail address and I will be happy to arrange a free consultation for the two of you at our Chestnut Hill office. He handles a lot of estate work. My e-mail is: [email protected]. Good luck.
