If my father is dead, who inherits money left to him by his father?

My father died in 2002. My grandfather (his father) died this year. My brother and I have recently found out that my grandfather never signed the new will that he asked for. His old will (which is a holgraphic will) leaves 1/3 of his estate to my father or heirs if he is not alive.(He has 2 living brothers) They ( the two brothers) want us to waive our rights and agree to a family amount that will be divided among the 7 grandchildren (5 belong to one brother, my brother and I and the other has none) first of all why would my mother not inherit? We were told it was us and second should we give in and agree to an amount to be divided amoung all of the grandchildren or do my brother and I as my fathers surviving children deserve this money for our children? Thank you.

If you agreed between the two of you you would receive 2/7ths which is @ 28.6%. If as written you and your brother would split 1/3 or @ 33% The main beneficiary is the five grandchildren who would be indirect beneficiaries of 1/3 and would increas there take to @71%. Is familial goodwill worth the 5%? That is something you have to answer yourself. The uncle who has no children is really stepping up as he is giving up his entire share under what you stated.
