Legal Question in Wills and Trusts in Pennsylvania

My mother was married when she passed away. There was no will. Can I sign for the release of her medical records or do I have to get legal representation of some sort?

No. Your mother's husband would have to be appointed as the administrator of your mother's estate unless he renounces and you or another sibling is appointed. If your mother lived in PA, then someone will have to apply for letters of administration and get what is called a short certificate. The hospital may also make the administrator fill out a HIPAA form before it will release the information.

You do not need an attorney to get the information but the information can only be released to the administrator of the estate or the estate or some other attorney. Even if an attorney is representing you, I think you still need appointed as the administrator first.
