The answer to your question will depend on the Deed. If the deed has your mother and sister's names and say the words, "Joint with Rights of Survivorship", your mother's interest in the property goes to your sister named on the deed. If the deed says "Tenants in Common", your mother's interest will be part of her estate. If the deed does not say "Joint with Rights of Survivorship" or "Tenants in Common", it is presumed to be held as tenants in common, and your mother's interest in the property will be part of her estate.
