Legal Question in Wills and Trusts in Pennsylvania

My uncle has power of attorney and just put my grandmother in a nursing home. I've lived with her for 31 years and took care of her towards the end when they put her in the home. He is now selling the house and is kicking me out. I have legally resided here for 31 years, is this something he can do?

Do you either have a (a) written or oral lease; or (b) do you have an ownership interest in the property (are you on the deed)?

If the answer to both questions is no, then you have no right to stay in the home. Living there for 30 years gives you no rights under the adverse possession laws as your staying there was presumably done with the owner's permission.

With a valid POA, your uncle can do anything which your grandmother could legally do. I assume that the POA was properly drafted and permitted your uncle to handle real estate transactions for your grandmother. If so, then your uncle is entitled to sell her land.

I am sorry. I am sorry that this is not wahat you wanted to hear and you are free to solict the advice of another attorney. If you wish to stay in the home, then why don't you arrange to buy it?
