Insurence company scheduled an independent doctor appointment

I was injured in March of 2007. My company's doctor misdiagnosed my injury as a sprain. I have (Turf Toe). I had to go through therapy through the companies theorist, for the 1st month and a half. It did not get better and it made the injury worst. They then sent me to an ortho specialist that said No therapy or manipulation. The company continued theory, (1) session and then abruptly stopped. I have been off of work since then. I still have the same amount of pain as the day I was injured. I was given treatment but no relief. I continued to see the specialist, until he recommend a nerve specialist. I have the appointment scheduled with him. My pcp recommended him also and that is who I want to see. Now the insurance company sent me a letter saying that they scheduled me an appointment with another doctor, that was not recommended by my pcp. Do I have to go see this doctor? 3 weeks prior to this letter the insurance called me and asked if I would like to see this doctor, I replied no and that I would like to stay with my appointment that I made with the recommended doctor. Also do I have a case with the misdiagnosis and the continuing of therapy?

I think you are limited to workers' comp for the malpractice case because it is a company doctor. As for seeing a doctor, the company can send you to as many exams as are reasonable. There's not much use in fighting them because it just angers the judges who'll order you to go anyway.
