Legal Question in Workers Comp in Pennsylvania

Pay compensation for time missed from work

I was injured on the job, left pinky crushed and broken in 2 places. My employer does not want to pay me for the time I was away from work to seek medical attention, for 6 hours the following day and when I have to return for check ups. This will add up to about 10 hrs total. They say since I am only part time it is different.... as well as the bookeeper wants my husbands insurance to cover the medical cost and not reimburse us for the co-pay. What are my legal rights concerning this?

There may be an applicable waiting pertiod for cash benefits. However, your medical costs are covered under the worker's comp insurance and it would be illegal for the employer to force you to use private insurance to pay for the bills. I offer free consultations.

Re: Pay compensation for time missed from work

1) Your employer has to pay for any medical bills related to treatment for the work injury. 2) there is a waiting period to obtain lost wage disability payments, no matter if you're full time or part time. If you are unable to work 5 work days or less, you are not entitled to receive lost wages. If you are disabled from 6 to 10 work days you are entitled to receive lost wages for those days. If you are disabled more than 10 work days, you are entitled to obtain lost wages for all days you are disabled, including days 1 - 5. These days do not need to be consecutive, so for example, if you miss 2 days, return to work for 4 days, & then miss 4 more days, since you were out 6 days in total, you get 1 day of lost wage payments. Good luck!!
