what happens if a person spends a workers comp MSA on things other than their medical needs?

If you are not a current recipient of medicare/SSI/SSD and your lump sum is less than 250K you should be all right. See your attorney to discuss other factors, to ensure there will be no set-off as against future forseeable medicare reimbursements.
