Legal Question in Civil Rights Law in Philippines

good afternoon atty. My mother has been attending my brother's case for more than 10 yrs now. He was stabbed and in coma for months. The accused was caught but released by bail. My brother is now in the US for 9 yrs and my mother and a witness are the ones who are attending the court religiously. For more than 10ys the accused is still free because they are "friends" with the fiscal and everyone in the court. They cancel the hearing anytime they want. MY mom said that for every hearing she pays the fiscal 500php. my question is that can we settle it even if my brother is out of the country?If so, How? The fiscal said there is a big possibility that the case will be dismiss if we dont agree for settlement,problem is they want my brother here ASAP. My mother doesnt want us to get involve in the case because of threats but i really want to help her because shes too old now. pls advice.
