Legal Question in Civil Rights Law in Philippines

I have live in partner of 4 years now.We have adopted baby and we bought houses here.We have good business but i found out that he got an affair with another lady.Is there any chance that our property even under his name can be our conjugal property?please help..thanks

The property relations will depend on whether you or either of you have legal impediment to marry. If one of you has previous marriage the rule on co-ownership will apply in so far as to the properties acquired through actual contributions of the common law spouses. This means that the ownership of properties belongs to the spouse who made the actual contribution in its acquisition. Even if registered in his name if you can prove that he has no contribution on its acquisition then you can still validly claim the property.But you have to initiate a case on this.
