Divorce in the Phillipines

I want to get married to a girl from the Phillipines living in the US, but she is still married in the Phillipines. There is no such thing as a divorce in the Phillipines. Can we get a marriage license in the US? I am a US citizen. How can we get married? She has been seperated for 8 years living in the US for 6 years. She has been living with me for about 2 years in California.

Please help

Your sitaution is not particularly difficult.

Have your fiance file for divorce here in California and serve the spouse in the Philippines. As soon as the divorce is final you can then legally marry.

To legally marry her she would first have to be divorced. Since she is a resident of the State of California, she can file for sissolution of marriage here.

For a specific opinion regarding her individual circumstances, I suggest that she consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

You may problems in securing an Affidavit of legal apacity in the Philippine Embassy for your Filipina fianc�e.

I suggest that your fianc�e should file a Petition for Annulment of her previous marriage here in the Philippines.
