Legal Question in Family Law in Philippines

Please give me your thoughts on this

Hi Atty, I would like to seek your advice. My wife and I are separated for almost 4 years now. We had several legal encounters like for child support though eventually she could not pursue any case against me since I was regularly sending my financial support. However, 2 months ago she sent me a message telling me not to support our son anymore since she is leaving for another country. This news of her going abroad also reached our close friends. As she mentioned, she left the country last November.

With this, I stopped sending my financial support because if she really left the country, I am not sure that the money I will be sending will be spent for my son. Nevertheless she also sent a message telling me to stop my support and forget about them.

I am with someone right now, and she is presently pregnant right now, what legal precautions may I take to protect the new family that I would like to build. please advise. thanks

better file an annulment so that you can legally married again and to avoid any crminal case that may be filed by wife against you.

You have to file a case for the nullification of your marriage. While you wife is away, no one knows what her future would be. Should she run aground and needs money, she may look for you as a source to bail her out. She can then pressure you by filing or threatening to file case/s as what transpired prior to your separation de facto. Also, to protect your new partner, while your trying to build a new family, it would be best to legitimize your separation with your wife and marry your present partner. Thanks
