Legal Question in Family Law in Philippines

Good day! I am a Filipino cit married to a US cit, residing here in Phil. We have a 7yr old daughter born here in 2002 (she's dual citizen) & we got married 2007. Im a housewife & my relationship w/ my husband is not doing pretty well right now. I don't want to lose my daughter & I am afraid that our relationship is going to an end. No third party involved. I want to know what is my status, given the situation. Not much savings, by the way, to file for annulment myself. Im afraid that he will take my baby away & the fact that he can do so, since my daughter is already 7yrs. old. Will appreciate your thoughts.

He cannot simply take away your daughter from you. If he is not providing for support then file a criminal case for violation of RA 9262 , economic violence and ask for a temporary protection order with provision for support and custody of the child. There will be a hearing thereafter so that this temporary protection order will be converted into a permanent protection order.Such actions will compel your husband to provide support to you and your daughter. Moreover, he will be required to stay away from you and daughter. Good luck to you.
