Legal Question in Family Law in Philippines

validity of marriage contract

A year ago i was got married to a woman without ceremony and a solemnizing officer. It happens because her mother is working as a secretary of our municipal mayor. Her mother gave us a copy of marriage contract already signed by the mayor and the witnesses and told us just to signed the contract and will do the rest of processing (registration at civil registrar). I want to know if this contract is valid, if i still have the right to say that our married is illegal? Until now i dont know if our marriage is legal or registered at NSO. But i want to know if the contract is valid and considered legal despite of some irregularities.Thank you very much.

Re: validity of marriage contract

Contest your marriage on the basis that it lacks the formal requisite that there was no marriage ceremony. Why don't you check with the NSO if the alleged marriage contract was registered. If it was registered you will have a problem in overcoming the presumption of regularity in the performance of duty of the offical concerned who issued the marriage contract. It is another thing to prove those circumstances you are claiming in order to assail the validity of your marriage.
