Void Marriage

My husband was married in 1975 without my knowing. We were married last Feb 1984, how can I arrange all my documents so that my marriage with him will be legally invalid? My fiancee from UK wants us to married but I told him I must settle my documents first. How to settle my documents?

You need to file a Petition for Declaration of Nullity of Marriage on the ground that your marriage to your husband was bigamous without your knowledge. Simply because he was married before does not automatically invalidate your marriage. There must be a formal court declaration as required by the Supreme Court.

If the marriage of your husband with his first wife was still subsisting when he contracted marriage with you, your marriage is null and void for being a bigamous marriage. You must file a petition for declaration of nullity of your marriage with the appropriate Regional Trial COurt. You need legal assistance and representation to file this petition.
