while in kmart I slip and fell because there was sampoo on the floor I recieve injeries on my knee and back shoul I claim

The prevailing case law in Puerto Rico establishes that the duty of care due, by store owners, to the customers extends only to the exercise of reasonable care for the protection and safety of customers. Specifically, in connection with slip and fall cases, plaintiffs need to establish, and the Court needs to determine, that the existence of any such dangerous condition was known by the commercial establishment or such knowledge could be implied. Being that said, you must show that Kmart knew or should have known of the existence of the condition that allegedly caused your accident.
