Legal Question in Family Law in Puerto Rico

Child Support Tables

I live in the state of Virgina and and have two children living in Puerto Rico with their mother. I'm up for Child Support Revision. I wanted to know which table Child Support Enforcement will use?? Puerto rico tables are based on NET INCOME and Virginia Tables are based on GROSS INCOME. I prefer to used my Net Income to be used since I can manipulat a little my deduction in order to decrease my net income. Is there any way the Virginia tables (groos income) can be enforceed on me for the child support revision? How to avoid them?

Re: Child Support Tables

Your child support amount will be determined by the law and regulations of the state where your support order was entered and which continues to exercise jurisdiction over the matter.

Re: Child Support Tables

Since the order was entered in PR and continues to be enforced there, PR regulations will be applied. That means that you have to fill out a personal and economic information form which, as you stated, allows you to adjust your gross income and pay child support based on the resulting figure. Make no mistake, however, that adjusters will disregard any improvident adjustments, and will actually increase your liability if your increased expenses denote an augmented capacity to pay child support.
