Legal Question in Credit and Debt Law in Rhode Island

obtaining a judgment without service

Dear Attorney:

Could you please help me with a question. Can a debtor have a judgment rendered against him if the creditor was unable to have the summons served? If so, how is the debtor made aware of said judgment. Can the creditor execute the judgment if the debtor cannot be served?

Thank You

I do not practice law in your jurisdiction. I suggest you consult local counsel. It may be possible to obtain a judgement by publication with a court order. However, unless you know where the debtor or his assets are located, it is impossible to execute on the judgement.
