If a couple is separated, is the husband mandated to help with the wife should she need financial assistance?

In Massachusetts, if a Complaint for Separate Support has been filed separating the couple, certain Orders would be made by the court.

If the couple has children then child support would be ordered. Other financial support would rely on several other factors. Some of which include length of marriage and whether the wife worked out side of the home. If the wife is living in the marital home with the children the husband may be required to make mortgage payments.

The parties may agree on financial arrangements without a Complaint for Separate Support being filed.
