Legal Question in Sexual Harassment in Rhode Island

do i have case

i worked with a man for over year who made sexual overtures to me on a daily bases. he would put xrated pictures on my desk. this was always a picture taken out of a porn magazine.it would be gay or lesbians having sex. he also made comments regarding my breasts and ''ass'' to you his words.He would grab himself and talk dirty all the time.i brought this to the attention of the owner yet the harassment kept on.after september 11 (i am a travel agent) i felt my only recourse was to be the first to be laid off.The person in question still has his job and health benefits! i only kept one note that he left on my desk three days before i left.my family and friends have heard me complain of this abuse.do i have any type of case against my past employer for not firing him on the spot. she heard many of his comments first hand.

You don't say what the reason was for your lay off. However, you could have a claim for sexual harassment against your employer if they failed to stop the harassment after they knew about it. Unfortunately, you have left out some facts (when you left the job, how many employees, did this affect your work, etc.) which an attorney would have to know in order to give you a better opinion of your situation. I suggest you talk with a sexual harassment attorney ASAP. In discrimination cases you only have 180 days to file a claim after the discrimination or you lose your rights.
