Legal Question in Civil Rights Law in South Africa

Good morning! I paid the loan provider(company) in full. After 5 years a sheriff came with attachment on my furniture if I don't pay certain amount. I asked the loan company to provide with a original loan and statement of my payments. I was not given. Another 5 years down the line now in another province, they want to send a sheriff. I was not notified about the debt; I was not present when the judgement was issued. I want to start the case anew so that I defend myself. What should I do?

Good day,

I would suggest consulting an attorney in your area, so that he can make the needed applications to court. His fees should be recoverable from the loan provider as soon as all is resolved.

Kind Regards,

Melcom
