Legal Question in Bankruptcy in South Carolina

Order of Appearance

I had a chapter 13 dismissed in Virginia back in Feb '06 with 180-day ruling, but refiled again where my permanent address is in South Carolina in April '06. I received a letter from the court telling me to appear and tell why they should not dismiss my case and hold me in contempt of court and another legal term they used. Will I go to jail and what should I do?

If you don't have a bankruptcy lawyer, you should get one IMMEDIATELY. Your apparent disobedience to a court order may have serious consequences. Not knowing why you filed again within the 180 days, or whether you had legal advice, I will not speculate as to what might happen, or whether you have any defenses. This is not a subject you should discuss further in a public forum; instead, get a lawyer in SC and go over the matter in detail with him/her. Hopefully the worst that will happen is that your case will be dismissed.
