Legal Question in Criminal Law in South Carolina

Arrested from Trespass

I went to my sisters high school to have lunch with her. I entered through an unlocked side door, went to the cafeteria to drop off the lunch I brought and then went to the office to obtain a visitors pass. I was refuse the visitors pass and told it was a closed campus. I left the office, returned to cafeteria to get my things and was leaving when the resource officer arrested me for trespassing. Is this really trespassing? How can I keep this off my record as I don't have any criminal charges and don't want this to affect my ability to get a job in the future. I am only 18.

Re: Arrested from Trespass

If a person is instructed to leave a property and doesn't immediately do so, it can amount to trespass. In your case you were leaving, but went to retreive your things first. Did you tell them that you were going to go get your things before leaving? As far as keeping it off your record, there are a couple ways of doing that assuming you don't have a serious criminal record. Pretrial Intervention is one method of having it removed from your record. Call or email if you have any other questions. Robert Johnston [email protected]
