Legal Question in Criminal Law in South Carolina

assualt and battery charge

I was in my own home and two guys came over. It was late and I told them to leave. One of them provoked a fight after I told him he could not smoke in my house. While trying to defend myself, my front door swung open and I instinctively hit the person in the head with a ball bat that was standing behind the door. It was late, and we had all been drinking at a party. I was charged with aggravated assualt and battery. I have a good work record, I have never been in trouble, no arrests or anything, I feel like I acted in self defense. If I had it to do over, I would do it differently. Do you think I will have to serve jail time? or am I looking at probation. The person was a girl and she was not seriously injured.

Re: assualt and battery charge

Its really hard to make these sort of predictions. You explained your situation well, but its always helpful to see the Warrant, speak with the Solicitor, know what the victim might testify to, etc., before predicting what a person's sentence would be. Your welcome to call. What ever you do, make sure you have legal counsel. Assault and Battery of a High and Aggravated Nature is a serious offense.
