Simple Assault

My son got into a fight with his roommate. My son was cut with a knife and was treated at hospital. The other boy was not seriously injured. My son was arrested for simple assault. The other boy was not. Dont know why. Does he need representation. Can't afford a lawyer dont have enough time to get public defender. What would be the maximum sentence? Can he file for a postponement so he can get a public defender?

Here's answers to your questions:

1. I don't know why your son was arrested either. That would require reading the warrant and speaking with the police.

2. Yes he does need representation. He has been charged with a crime.

3. Maximum sentence for SIMPLE Assault, is 30 days in jail, fine, court courts, or any combination thereof.

4. He is probably not entitled to a public defender for Simple Assault, first offense, but certainly needs a lawyer. Are you sure its SIMPLE Assault?
