Legal Question in Criminal Law in South Carolina

My son was arrested and he is mentally handicapped

My son was arrested for entering a residence and trying to hug and kiss a women but he is mentally handicapped, has no speech. He is 24 years old and has a five years mentality. I would like to know if they can detain him. When he was fingerprinted they had to tell him that he was going to fingerpaint. He didn't understand his rights and really doesn't know why he was there at all. It is so confusing to me and to him. Please help.

You haven't said if bail was set for him. That is the first step in getting anyone out. Call the jail and ask about the bond (bail and bond are the same thing in this situation). Once bail/bond is set, then go get him out. Call me if you have other problems or questions. Bob Johnston (843) 828-1137
