Legal Question in Criminal Law in South Carolina

trespassing

I live in a condo complex in Spartanburg, SC. A neighbor sent the cops to a friend of mine's house who doesn't live here to tell him that he will be arrested for trespassing if he is seen at the complexes pool even if he is here as a guest with me. The complexes rules only say that a guest must be accompanied by a resident at all times at the pool. Can they do this? do I have any legal remedies for this? thank you. We own the condo but do abide by condo regulations.

Your question really doesn't have enough information in it to advise on. Did you talk with the neighbor and ask why he called the police? Did anyone ask the police why he couldn't return? Did you talk with the management of the complex to see what they know? There must be a reason. There are legal reasons to keep a person off the property even if they are a guest. For example. And its just an example. Say the guest has been selling drugs on the property, or getting intoxicated, or has been arrested on the property, or has caused a disturbance on the property. The fact that a person is a guest of a property owner doesn't necessarily give them a bullet-proof right to enter the property. There is obviously more to this story than what I have read. Wish I could have been more help. It sounds like you need to ask some questions.
