Legal Question in DUI Law in South Carolina

Drunk driver

My nephew was hit by a SUV while on the side of the road. Witnesses say he was in the road a little. the driver of the SUV was charged with DUI and arrested but not with contributing to the accident. This happened on a country road. Who is really at fault here? The drunk driver or my nephew?

I filed a Wrongful Death suit on a very similar case last year here in Horry County. My client was on a Moped and was killed. They said that he was at fault, but I didn't think he was. Even if they were both at fault a law suit can still be brought. Everybody is entitled to thier day in court. The police do not have the last word in these matters. Nor can you trust that you will get accurate information from the insurance company. Do you have a copy of the police report? I hired an expert witness who is qualified as an Accident Re-Constructionist.
