Legal Question in Family Law in South Carolina

college tuition payment in divorce

Divorce decree states each party will pay their portion proportionately and percentages were agreed upon. Mother failed to pay her portion leaving child with bad debt on his record. What can be done quickly and inexpensively to make her pay this debt and remove it from his (child's) credit report? The debt is approximately $1400

Re: college tuition payment in divorce

The child could bring a contempt action against the non-paying parent to have the Court force him/her to pay the portion required by the Order. Contempt actions generally take a month or two to handle, and the cost will vary depending on the part of the state, experience of the attorney, etc.

As for removing the debt from the child's credit report, it is impossible to answer that part of the question without knowing much more specific information. In some situations, it cannot be removed easily, if at all.
