Legal Question in Family Law in South Carolina

Custody Before Divorce

Is my husband allowed to pick up my child from the sitter while I am at work without letting me know? We are seperated, but time has not permitted me to take any legal action. What rights do I have to keep my child safe?

Re: Custody Before Divorce

If you are still married and have never been to Court, then you both have equal rights to the child in all aspects. Neither of you have rights superior to the other at this time. So yes, he can pick the child up from the sitter without notifying you.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
