Division of gifts

My domestic partner of 3 years and I are splitting up. He has asked for jewelry back that he gave me for Christmas and other occasions. Do I have to give it back?

Gifts are just that, Yours! Unless, you are married and then the gifts given during marriage could be part of the marital property in which each has an interest to be divided by the court. Unless you agree otherwise. This applies in South Carolina only.

One snare in the problem is that if you have held yourselves out as husband and wife, you may have a common law marriage.
