Legal Question in Family Law in South Carolina

divorce

My daughter has had to transfer with her job and has been in the middle of a rough divorce since March in TN. She has had to take a different job with her company to SC in order to be able to support my children. Her husband will not agree to the terms and keeps stalling and doesn't want to finalize the papers. He has since moved to AL. Can she file in SC and get it all taken care of in her now home state? She has lived here for almost 6 months with her children.

Re: divorce

Without knowing much more information, it's not possible to answer that question. However, if an action has been pending all along in TN, as it sounds, then that state will typically retain jurisdiction until the case is concluded, even if one party moves away.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
