Legal Question in Family Law in South Carolina

divorce/custody

My boyfriend is goin thru a divorce and wants visititaion w his kids. His wife is saying no due to the fact in the past I used drugs. I have no record and great references from work and personal references. I have not been in touch with with anyone from my past in over a year. I'm divorced from a man that has a bad reputation and was seperated since 07. Is there anyway she can use this against my boyfriend and limit him from his kids? Please tell me what I can do to help him and prove that we are fit to have his children.

Re: divorce/custody

While your conduct will be a factor, it will most likely not be a deciding factor. The burden will be on the mother to prove that you pose some sort of threat to the children, which will probably be difficult if you are not involved in any drug activity at this time.

The best thing you can do to assist your boyfriend is to ensure that he consults with an experienced family law attorney to find out what options are available to him based on the facts of his particular case.
