Legal Question in Family Law in South Carolina

Father's and Mother's rights concerning child custody

I recently had a baby. The father and I haven't spoken in 9 months. I contacted him to let him know he has a son. I was wondering what are his rights and my rights. He said he was going to fight me for custody and I am upset. I will appreciate any way you can help me. Thank you.

Re: Father's and Mother's rights concerning child custody

He doesn't really have any rights until a judge says he does. I assume by the way you worded your question that he hasn't visited the child. If he files for custody its doubtful that he would win, asssuming you are properly caring for the child. In all custody disputes the court will do whatever is in the "best interest" of the child. Since you have always had the child, and I have no reason to believe that you are not properly caring for the child, then I wouldn't think he could win. However, he can get a court order granting him visitation should he seek one. As far are your rights are concerned, you are entitled to child support from him, but again, only after you get a court order.
