Non-custodial parent financial obligation

In South Carolina, does a non-custodial parent have a legal obligation to assist in paying medical charges for an uninsured minor child?

In South Carolina, a parent has the statutory obligation to provide support for a child. This applies to both a custodial and non custodial parent. Medical services for the child are necessary services in the daily life of the child. Many times a judge will exempt the first $250.00 of medical charges incurred by the custodial parent when medical insurance is involved. The judge will then require an equal split of all remaining uncovered charges for medical services.

In this case, there is no medical insurance. The judge would probably order that the parents share in the cost of medical expenses on an equal basis, unless one of the parents has an income much larger that the other.

One thing is sure, if you are a parent you are obligated for support and support includes payment for necessary medical services.
