Legal Question in Family Law in South Carolina

Retirement Pay

I was awarded 1/2 of my ex's Military Retirement in our divorce settlement. He retired 9/3/07 and was to pay me direct starting 10/1/07until the army started paying me. I have contacted DFAS, they have all my paper work and that I should start receiving a check from them in December. My ex refuses to pay me. The military states that I would have to take him back to court...which I don't have the money to do. Now he has been recieving his retirement. He is also the Mayor of Folly Beach SC. What can I do?

Re: Retirement Pay

You can (and probably should) pursue a contempt action against him to recover the monies that he should be paying you and also to have him punished for his violations of the Court's order.

The Court generally requires the person held in contempt to pay attorney's fees and costs to the other side in most cases.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
