Legal Question in Family Law in South Carolina

I have been separated from my husband for 36 years. Can we get an uncontested divorce without a whole lot of red tape.? We are both 65 years of age . No property to divide and our children are grown.

Yes. Should be pretty easy and fairly inexpensive. The filing fee would be $150.00 and then a $25.00 Motion Fee. If you or your husband agree to accept service then the service of process fee should be just the cost of postage. One of you will have to go to court for the final hearing. You will need to bring a witness. The hearing itself is about 20 minutes but the wait maybe an hour or more depending on the court' s schedule. Not sure where you are in South Carolina but attorney fees should not be too much more than $500 to $700. At most I do not think you will have to spend more that $1,000.00.

If you do not want to spend the money and do not mind the aggravation of doing something you have never done before you can go to the South Carolina Judicial Website and download pro se divorce information and forms. Good luck!
