Son does not want to go back home

My 13 year old son lives in TX with my ex. he has told her that he wants to come live with me, his father. My ex keeps putting him off. He is here, Myrtle Beach, for summer visitation and wants to stay, I know I can't legally keep him, he has called his mother since he has been here to tell her he wants to stay and again she refuses to address the issue, looks like I am headed to court. Will his age be a benefactor on a judges decision?

Age will be a factor in the Judge's decision. However, The law requires full faith and credit be given to another state's orders. You did not mention the state of divorce. I assume it is Texas. You have a hard row to hoe. YOu should consult an attorney as soon as possible. Failure to return a child to the custodial parent when visitation has ended is serious and could be criminal.
