Legal Question in Family Law in South Carolina

Step child adoption/ Child Support

I had a child with a woman 5 years ago. We were never married. She has since married another man 3 years ago. They would like to adopt the child I had with said woman.

I currently pay the mom child support and have some CS in arrears. Can the mother agree to forgive the CS in arrears if I agree to give up the child for adoption?

Thanks for your insight.

Re: Step child adoption/ Child Support

She can agree to waive the past due child support, but it must be approved by the Court. It is not uncommon for that to happen as part of a step-parent adoption such as what you have referenced.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
