Legal Question in Family Law in South Carolina

unreimbursed medical expenses

Are unreimbursed medical expenses considered part of child support? My ex is in default on court ordered unreimbursed medical expenses can we get his wages garnished for the $1700. I have a court order stating he is to pay it. He is in the army and we're going thru DSS but the people there are morons and don't have a clue.

Re: unreimbursed medical expenses

Uncovered medical expenses are part of supporting the child, but not a part of the weekly/monthly child support amount set by the Guidelines. Typically, each parent is required to pay a set percentage of all such expenses, and if that parent doesn't pay his/her share, the other parent can file a contempt action to enforce the Court's Order.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
