Legal Question in Civil Litigation in South Carolina

I just found out that gym has been taking $39 out of an account of mine for about 6 years, which I thought I had ended. I do not have a copy of the letter I sent nor can I prove that I closed the account. The gym is located in Charleston SC where I lived but I closed the membership when I moved to Puerto Rico. Now I live in Alabama. Can I take legal action based on the fact that I moved out of the area where the gym was located? Also, the main office is not willing to get me a copy of my contract because I'm no longer at the address in SC so I cannot verify the contract terms. Thanks

The only question you asked was whether you could take legal action due to moving out of the area. I doubt that would be sufficient.

You really need a copy of your contract. It spells out who has what responsibilities and obligations. Maybe you could contact the SC office. Or for that matter, have a friend contact them as a potential new client and see what the contact says. It might not be the same, but it might. Surely you can get a copy of the contract somehow. Without knowing the agreed upon terms to terminating membership and not being able that you in fact did terinate it, your going to have problems since they removed money from your account and you never spoke up about that. I wish you the best
