Regarding L1 to H1

hi ,

I currently have only valid I94 on my L1. I got H1B (2007) approved for consular processing. Then I applied for I824 to change my consulate ( from Chennai to Toronto ) which got approved 6 weeks back.

2. My assumption is, once I go for H1 visa stamping to Toronto, the first thing the consular does is cancel my L1. So, should I resign before I go for H1 stamping ? Is there a facility or some kind of grace period which allows me to work legally on L1 for sometime till I get started on H1B...which I assume will take maybe 4 weeks or so.

2. What happens if in worst case scenario they ask for more information or reject my H1B visa. Will I have to go back to India ?

If you are asking if you can work on L-1 once you have been granted an H-1 the answer is no. You cannot hold L-1 status and H-1 status at the same time.
