i would like to marry an illegal immigrant but does he have to go back to his country first?

You can marry him in the USA if both of you single and legally able to marry. However, he might have to go back to his country before "becoming legal" or obtaining a permanent resident status/green card if he came to USA illegally without a visa and no one had ever petitioned for him in the past.
