Legal Question in Employment Law in South Carolina

medical leave

I was in a car accident on thanksgiving day last year, I went on disability so I can do my physical therapy, I was in a lot of pain due to the accident, I work in the department of medical records at a nursing facility; I was informed by a co-worker of mine who also was in a car accident in April of 07, she just returned back to work fulltime in her same position...She stated to me that one of the owners was mad at me because I was out due to my injuries and that my position in medical records was being striped from me even though they have'nt hired anyone to take my position. I have work for this company for over a year basically working seven days a week on call 24-7. When the owner gets mad at one of the employees she either wants to fired them or treat them really mean. I still have pain, my doctor is releasing me too--name removed--back to work next month, can my employer actually take my title away even though I was hit really hard from behind; the accident was'nt my fault and my employer should'nt blame me for this accident by taking my job title away. I'm a good employee and my co-workers will agree.

Re: medical leave

At will employment issues are very case sensitive. Generally, if you do not have an employment contract than they can fire you for cause or without cause. Do you have an attorney for your rear end accident? If not, contact me Pasquale Calcagno, Esq. for a free consultation at 1(800)WE-FIGHT.
